Right of withdrawal

The procedure for returning purchased products is simple and convenient.
If for any reason you are not satisfied with your purchase, you can exercise your right of withdrawal, without any penalty, within seven (7) working days from the day you received the products purchased on www.luxechocolat.com
You will not be able to return products customized with your name or logo in accordance with your specifications.
The products can be returned by shipping the package via the indicated courier or via another courier after completing an appropriate return declaration, according to the terms indicated below.

How to exercise the right of withdrawal
You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within seven (7) working days, from the day of receipt of the products purchased on www.luxechocolat.com, by notifying the Seller.

To exercise the right of withdrawal, you must inform the Seller of your decision to withdraw. To this end, you can: (i) use the Return Form, or (ii) submit any other explicit declaration of your decision to withdraw (the declaration must contain at least the following information: the order number, the product(s) purchased, your personal details and address, as well as your bank details – account holder and number, ABI, CAB, CIN – for the refund of the amount paid).
You must return the products to the Seller by handing them over to the courier for shipment within seven (7) working days from the day on which you exercised the right of withdrawal, communicating your decision to the Seller.

The only costs you will have to pay are those for returning the purchased products.
If you decide to use the carrier indicated by the Seller in the Return Form, you will not, however, have to pay the costs, at your expense, for returning the purchased products. The payment of the costs for returning the purchased products will be made, on your behalf, directly by the Seller, who will therefore release you from any payment obligation towards the carrier.

The Seller, for the payment of the return, will in fact withhold from the refund a lump sum equal to the cost previously incurred for shipping and delivery to your address of the purchased products. From the moment of returning the purchased products to the carrier indicated by the Seller in the Return Form, the Seller exempts you from any liability in the event of loss or damage to the products during transport.
If you decide to use a carrier other than the one indicated by the Seller in the Return Form, you will instead have to pay the costs, at your expense, for returning the purchased products. In this case, the cost previously incurred for delivery of the purchased products to your home will also be refunded, however, any liability in the event of loss or damage to the products during transport will remain your responsibility.

The Right of Withdrawal is considered to be correctly exercised if the following conditions are also fully respected:
the Return Form or any other explicit declaration of the decision to withdraw are correctly completed and sent to the Seller within seven (7) working days of receiving the products;
the products must not have been used or damaged.

You will be responsible for any decrease in the value of the product resulting from handling of the product other than that necessary to establish the nature, characteristics and functioning of the product; the products must be returned in their original packaging with an appropriate identification tag;
the returned products must be delivered to the carrier within seven (7) working days from the date on which you received the products.

If the Right of Withdrawal is exercised following the methods and terms indicated in this paragraph, the Seller will refund any sums already collected for the purchase of the products according to the methods and terms provided.
The sums will be refunded to you as quickly as possible and, in any case, within seven (7) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the refund procedures, once the correct execution of the terms and conditions indicated above has been verified.

If the terms and conditions for exercising your right of withdrawal, as specified in this paragraph, are not respected, you will not be entitled to a refund of the sums already paid to the Seller; however, you will be able to get back, at your expense, the products in the state in which they were returned to the Seller. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase.

Refund times and methods
After the return of the products, the Seller will carry out the necessary checks relating to their conformity to the conditions and terms indicated in the previous paragraph. If the checks are concluded positively, the Seller will send you, via email, the relevant confirmation of acceptance of the returned products.
Whatever the payment method used by you, the refund is activated by the Seller, as quickly as possible and in any case within seven (7) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verifying the correct execution of your right of withdrawal and acceptance of the returned products.

The actual time for the refund or reimbursement of the sums paid for the purchase of the products depends on the payment methods used:
orders paid by credit/debit card: the refund time depends on the credit/debit card management company, but normally occurs within two bank statements. We remind you that the value date of the refund is the same as the debit, therefore you will not suffer any loss in terms of bank interest
payment on delivery: the refund is made to the current account indicated by you, therefore the refund time depends on the correctness of the data specified; normally the refund occurs within seven (7) days.

The Seller indicates the shipping company for the return of the products on (depending on the courier that delivered the order to you).
Through the indicated courier, you can return the products to the Seller, without having to pay the necessary expenses yourself.
According to the methods and terms provided for exercising the right of withdrawal, this method allows the Seller to directly pay, on your behalf, the costs of returning the purchased products, freeing you from any payment obligation towards the carrier. This method also allows you to check, at any time, where each package is located, freeing you from any liability in the event of loss or damage to the products during transport.

If you decide to use a carrier other than the one indicated by the Seller to return the products, you will instead have to pay the necessary costs yourself and you will be responsible for any liability in the event of loss or damage to the products during transport, according to the methods and terms provided for exercising the right of withdrawal.
