These general terms of sale regulate the purchase of products made online through the website www.luxechocolat.com. The products purchased on www.luxechocolat.com are sold directly by Luxe Chocolat S.r.l., hereinafter referred to as the "Seller".
Luxe Chocolat S.r.l. is a company registered in the Register of Companies of Cremona, C.F. and VAT number 01821630199, registered office in Via Libero Grassi 4, Bagnolo cremasco (CR) Share capital Euro 10,000.00 fully paid up.

1. Our commercial policy
1.1
The Seller offers products for sale on www.luxechocolat.com and carries out its e-commerce activity exclusively towards its end users, consumers, professionals and legal entities.
1.2
These General Conditions of Sale exclusively regulate the offer, sending and acceptance of orders between the users of www.luxechocolat.com and the Seller.

2. How to conclude the contract with the Seller
2.1
To conclude the purchase contract for one or more products on www.luxechocolat.com you must fill out the order form in electronic format and send it to the Seller, electronically, following the relevant instructions.
2.2
The order form contains a summary of the information on the essential characteristics of each product ordered and the relative price (including all applicable taxes or duties), the payment methods that you can use to purchase each product and the delivery methods of the purchased products, the
shipping and delivery costs, the conditions for exercising the right of withdrawal and the methods and times for returning the purchased goods.
2.3
The contract is concluded upon receipt by the Seller, electronically, of the order form, after checking the accuracy of the data relating to the order itself.
2.4
Before proceeding with the purchase of the products, you will be asked to carefully read the General Conditions of Sale.
2.5
The order form will be archived in our database for the period of time necessary to process the orders and in any case within the terms of the law. You can view your order form by accessing the reserved area with your codes.
2.6
The Seller may not process your purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. In these cases, we will inform you by email that the contract has not been concluded and that the Seller has not followed up on your purchase order, specifying the reasons. If the products presented on www.luxechocolat.com are no longer available or on sale at the time of your last access to the site or when you sent the order form, the Seller will inform you, within thirty (30) days from the day following the day on which you sent your order to the Seller, of the possible unavailability of the products ordered. In the event of forwarding the order form and payment of the price, the Seller will refund the amount already paid by you.
2.7
By electronically transmitting the order form, you unconditionally accept and undertake to observe, in your dealings with the Seller, the above General Conditions of Sale. If you do not agree with some of the terms set out in the General Conditions of Sale, we invite you not to submit the order form for the purchase of products on www.luxechocolat.com.
2.8
By transmitting the order form, you confirm that you know and accept the General Conditions of Sale and the additional information contained in www.luxechocolat.com, also referred to via links, including the General Conditions of Use, the Privacy Policy and the Information on the Right of Withdrawal.
2.9
Once the contract has been concluded, the Seller will send you, by email, a receipt of the purchase order, containing a summary of the information already contained in the order form.

3. Guarantees and indication of product prices
3.1
The essential characteristics of the products are presented on www.luxechocolat.com within each product sheet. The images and colors of the products offered for sale on www.luxechocolat.com may however not correspond to the real ones due to the Internet browser and monitor used.
3.2
The Seller does not sell used, irregular or lower quality products than the corresponding standards offered on the market.
3.3
The Seller, in the event of exercising your right of withdrawal, has the right to not accept the return of products that have been altered in their essential and qualitative characteristics or that have been damaged.
3.4
Product prices may be subject to change. Make sure of the final sale price before submitting the relevant order form.
3.5
Purchase requests from countries not present among those on the country selection page cannot be accepted by the Seller.

4. Payments
4.1
The prices displayed include VAT, packaging and wrapping.
4.2
To pay the price of the products and the related shipping costs you can follow one of the methods indicated in the order form.
4.3
In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiration date) will never be used by the Seller except to complete the purchase transactions and in the event of issuing refunds, following the exercise of your right of withdrawal and the related return of the products, or if it becomes necessary to prevent or report to the police the commission of fraud on www.luxechocolat.com.
4.4
The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged to your current account at the time of shipment of the purchased products.

5. Shipping and delivery of products
5.1

6.1
You can request any information from the Seller through Customer Service.

7. Right of withdrawal
7.1
You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within seven (7) working days, from the day of receipt of the products purchased on www.luxechocolat.com, by notifying the Seller.
7.2
To withdraw from the contract you must specify the products purchased, the relevant order number, your identification data and bank details (account holder and number, ABI, CAB, CIN) for the refund of the amount paid for the purchase of the products. You must return the products to the Seller who must receive them within seven (7) working days starting from when you received the products.
7.3
The shipping costs for the original delivery of the purchased products will not be refunded. The return shipment, however, is free, if you decide to use our courier. If you decide to use a different courier, the return shipping costs will be at your expense.
7.4
The right of withdrawal is however subject, in addition to the conditions specified in the previous points, also to the following conditions:
• The waybill must be correctly filled out
• The right of withdrawal applies only to goods that are intact at the time of return;
• The products must not have been used, modified or damaged;
• The products must be returned in a single shipment to the Seller;
• The products must be returned in their original packaging;
• The Seller must receive the returned products within seven (7) working days from the date of delivery of the order.
7.5
In the event that the withdrawal is exercised in accordance with the conditions set out above, the Seller will refund the customer the entire sum received for the purchase of the products, within seven (7) days from the date on which the Seller became aware of the exercise of your right of withdrawal.
7.6
If the methods and terms for exercising the right of withdrawal are not respected, you will not be entitled to a refund of the sums already paid to the Seller; however, you will be able to obtain, at your expense, the products in the state in which they were returned to the Seller. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase.

8. Refund times and methods
8.1
After the return of the products, the Seller will carry out the necessary checks relating to their conformity to the conditions and terms indicated in paragraph 7. In the event that the checks are concluded positively, the Seller will send you, by email, the relevant confirmation of acceptance of the returned products.

10. Applicable law and dispute resolution
10.1
The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206, on the consumer code in Chapter I "Consumer rights in contracts", with specific reference to the legislation on distance contracts and by Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.
10.2
In the event of disputes between the Seller and each user, arising from the General Conditions of Sale, we inform you that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, accessible on the site https://ec.europa.eu/odr.

11. Modification and update
12.1
The General Conditions of Sale are modified from time to time also in consideration of any changes to the legislative provisions. The new General Conditions of Sale will be effective from the date of publication on www.luxechocolat.com.
